If the parents of a child are not married and they split who gets physical & legal custody of child?

This child is in our pre school program. Child lives with Mom. Mom does not want Dad ( he is bio Dad) to have any contact. (no court paperwork) Is this her right? Dad's name is on the birth certificate. Also what if they were married, split, still no court paperwork re: custody or visitation. Who gets to call the shots?
