Improper Distribution of Construction Loan

A contractor made a partial payment to me for work performed. Now a law firm says that he used money from a construction loan on another project and that I must repay to 'loaned' money plus interest to the lendor. There was no indication on the check as to where it had originated.

I am having a house built and the the builder spent more than the allowances allowed without my approval, do I have a leg to stand on? I have not signed the change orders that are in discrepancy. The work was done prior to receiving a change order or knowing the cost of the change.
