Obamacare Unconstitutional

If the Courts are finding Obamacare unconstitutional for compeling citizens to purchase health insurance or pay a penalty, why am I being penalized for not signing up for Medicare's Drug Coverage Plan? (I am 71 years old and receiving Social Security and Medicare.) I have never been on a drug regime nor do I anticipate being on a drug regime in the future and, therefore, paying $25+/- a month for drug coverage was not feasible to me. If I had signed up for the coverage in the beginning I would have paid thousands of dollars for coverage I did not use. Now I am being penalized $5.50 a month for not signing up. Isn't this the same argument that is being litigated regarding Obamacare?
