I was in a car accident several years back, and my lawyer went to work on the case. This was about in 2004. My lawyer has been giving me the run around, saying, that we are going to court, he's sent out the paper work to the other party who caused the accident, and he will here something pretty soon. It is now 2012 and I can not get any information from my lawyer. He will not return my calls, and when I ask to make an appointment, he never has time to see me. This has been going on for the last few years. I believe that he has gotten the settlement for my case, and has spent the money, because he has made no effort to contact me. He is avoiding me. When I tried to get another lawyer on the case, he would not give that lawyer any information at all. Please tell me what to do. Should I file against him, or what should I do?

Hi,
The first place to start is to contact the state bar where you live and let them know the situation. They should be able to not only allow you to make a formal complaint but also direct you to another lawyer that can assist you in looking into what happened. Every state is is different in how they govern their lawyers but all states have a complaint mech.
A lot of time has passed and I would want to make sure that your time to file the suit has not lapsed. If it has, you may be able to seek indemnification from that lawyer for malpractice.
