I am a 54 year old woman who has exhausted all funds for legal help. I am divorcing an abuser I was marred to for 30 years. youngest child is 19. Criminal trial has been postponed for over a year assault and battery. 209A has been violated twice. Husband has only paid court ordered alimony 5 times in 9 months. He has not paid mortgage in house he lives in though he was ordered to do so but has collected rents for rental unit in same. House is in foreclosure. What now? Probate scheduled for Oct 13 foreclosure Oct 4 crimanal trial July 11 (if it takes place).
You need to file a Complaint for Contempt. My office offers limited assistance representation. The legal fee is allowed to be contingent on the back alimony collected as this is a debt collection action.
As for the house, have you considered bankruptcy or a pre-foreclosure sale? As for the alimony, a Complaint for Contempt is the remedy when someone is not complying with an order or judgment. You can try to get representation through Legal Services, and if you do not qualify then call a local bar association or the Mass. Bar Association for a reduced-fee referral to a family law attorney.
