What are the chances of not getting deported for first offence

My boyfriend was charged with a violation of Health and Safety Code. Was sentenced 37 days time served 3 years Non federal probation with search terms. But because he's a legal He was not released due to an ice hold. This being his first ever offense Would that give him a better chance of not being deported.
