What can I do about a collection agency taking me to court?

Just found out that I have three warrents for my arrest, theft taking (using illegal power) property damage (connecting power on after being disconnected), criminal trespassing (I lived at the apt during the time and have since then moved into a small apt on the same property)

My husbands unemployment ran out a year ago.and has been unemployed for three years, and we need a lawyer for a divorce. He says we dont I say we do. Hes 58. So if he takes some hardship money out of the 401k early, does he still recieive as bad a penalty or a penalty at all since hes been unemployed?
